Plain-language notice: Get Your Bike is a marketplace that connects riders with independent, third-party scooter rental shops in Da Nang. We do not own, inspect, insure, or rent out any bike ourselves — every rental is a direct agreement between you and the shop. Read below for exactly what that means for your data, your booking, and who is responsible for what.

1. Who we are

"Get Your Bike" ("we", "us", "the Platform") operates a website and booking system that lists scooter rental shops ("Shops") in Da Nang, Vietnam, and lets customers ("Riders", "you") browse, compare, and request bookings. We are based in and operate under the laws of Da Nang, Socialist Republic of Vietnam.

2. What the Platform is — and isn't

Get Your Bike is a booking facilitator, not a rental company. Every Shop listed on the Platform is an independently owned and operated business, solely responsible for:

  • The condition, safety, maintenance, and legal roadworthiness of its bikes;
  • The accuracy of its own listings, pricing, and availability;
  • Reviewing and approving or rejecting booking requests;
  • Collecting payment directly from you (the Platform does not process rental payments or hold funds);
  • Complying with Vietnamese business, insurance, and vehicle-registration law that applies to its own operation.

We do not inspect bikes, verify Shop insurance, or guarantee the accuracy of any Shop's listing. We are not a party to the rental agreement formed between you and a Shop once a booking is approved.

3. How a booking actually works

  1. You submit a request through the Platform, including your name, phone number, and (for bikes 50cc and above) photos of both sides of a valid driving license or International Driving Permit.
  2. The Shop reviews your request and chooses to approve or reject it — the Platform does not approve bookings on a Shop's behalf and cannot force a Shop to accept a request. If a Shop does not respond within 48 hours, the request automatically expires and is cancelled — no charge is ever made either way, and you're free to book with another Shop.
  3. You and the Shop coordinate directly — pickup or delivery, deposit terms (if any), and a walkaround video at handover, as agreed between you and that Shop.
  4. Payment happens directly with the Shop — in cash or by whatever method that Shop accepts. The Platform never collects rental payment.
  5. Any dispute about the bike, the rental period, damage, deposits, or refunds is between you and the Shop. The Platform may, at its discretion, help facilitate communication but has no obligation to mediate or compensate either side.

4. Your responsibilities as a Rider

  • You confirm that any license, ID, or document you upload is genuine, current, and belongs to you. Uploading a fake, altered, expired, or someone else's license is entirely your own legal responsibility — not the Platform's and not the Shop's, unless the Shop knowingly accepted a document it had reason to doubt.
  • You must hold a valid driving license or International Driving Permit (1968 Vienna Convention) to ride any bike 50cc or above, as required by Vietnamese law. Bikes under 50cc do not require a license for foreign riders under current Vietnamese regulation, but you remain responsible for confirming this still applies to your situation.
  • You are responsible for riding safely, following Vietnamese traffic law, wearing a helmet, and for any fines, accidents, injuries, or damage that occur while the bike is in your possession, per your agreement with the Shop.
  • You must be legally permitted to enter into a rental contract (generally 18 years or older).

5. Shop responsibilities

  • Shops must list accurate bike condition, pricing, and availability.
  • Shops are solely responsible for their own compliance with Vietnamese law regarding vehicle registration, roadworthiness, and any required business licensing or insurance.
  • Shops must not discriminate unlawfully in accepting or rejecting bookings.
  • Shops are responsible for the security and lawful handling of any Rider documents (e.g. license photos) shared with them through a booking, and must not use them for any purpose beyond verifying that booking.

6. Limitation of liability

To the maximum extent permitted under Vietnamese law, Get Your Bike, its founders, and operators are not liable for: any injury, death, property damage, theft, financial loss, fine, or legal consequence arising from a bike rental, a Shop's conduct, a Rider's conduct, or any dispute between a Rider and a Shop. The Platform is provided "as is" without warranty that listings are accurate, that Shops are reliable, or that the service will be uninterrupted or error-free.

Nothing in this section limits liability that cannot lawfully be excluded or limited under Vietnamese consumer-protection law.

7. Account suspension and platform moderation

We may suspend, reject, or remove a Shop or Rider account at our discretion — including for fraud, repeated disputes, fake documents, abusive behavior, or violation of these Terms — without that decision itself constituting a resolution of any underlying dispute between a Rider and a Shop.

8. Governing law

These Terms are governed by the laws of the Socialist Republic of Vietnam. Any dispute arising from use of the Platform that cannot be resolved directly will be subject to the jurisdiction of the competent courts of Da Nang, Vietnam.

This document is a good-faith plain-language policy, not formal legal advice. It has not been reviewed by a Vietnam-licensed attorney. If you are relying on this for a real commercial launch, have it reviewed against current Vietnamese e-commerce, consumer-protection, and personal-data-protection regulation (including Decree 13/2023/NĐ-CP on personal data protection) before treating it as binding.

1. What we collect

  • Riders: name, phone number, and — only when required for a specific booking — photos of both sides of your driving license or International Driving Permit.
  • Shops: business name, phone number, address/area, and bio/description you choose to provide.
  • Automatically: basic booking records (which bike, which shop, dates, status) needed to operate the service.

2. Why we collect it

  • To let a Shop verify who is requesting a bike and review your booking;
  • To let you log in and see your own booking history;
  • To let a Shop contact you about your booking;
  • To operate, secure, and improve the Platform.

By registering an account, requesting a booking, or uploading a license photo, you consent to this collection and to the specific Shop you're booking with receiving the information needed to fulfil that booking.

3. Who can see your license photos

Your license photos are visible only to: (a) the specific Shop you booked with, for the purpose of verifying that booking, and (b) the Platform operator, for security, fraud-prevention, and legal-compliance purposes. Other Shops and other Riders cannot see your documents. We do not sell your data to third parties.

4. Where data is stored

Booking and account data is stored in a managed Postgres database (Neon) and uploaded images are stored via Vercel Blob storage, both operating on infrastructure that may be located outside Vietnam. By using the Platform you consent to this cross-border storage, which is used solely to operate the service described above.

5. How long we keep it

We retain booking and account records for as long as your account is active plus a reasonable period afterward for legal, dispute-resolution, and fraud-prevention purposes. You can ask us to delete your account and associated data at any time by contacting the Shop or Platform directly; some records may be retained where required by law.

6. Your rights

You may request access to, correction of, or deletion of your personal data, and may withdraw consent for future collection by closing your account. Withdrawing consent does not affect bookings already made or data we are required to retain by law.

7. Security

We use password hashing, signed session tokens, and access-controlled storage to protect your data. No system is 100% secure; if you believe your account has been compromised, contact us immediately.
